Cross-border Fund Clarity — SBV & Treasury Retainer
For foreign-invested companies, branches and individual investors that move capital, loans, dividends or liquidation proceeds across the border more than once a year. Not a bookkeeping service — it sits alongside your accountant and bank. The working scope is confirmed only after reviewing the circumstances, available records and current requirements.
What you receive
- 01
Quarterly transfer calendar — Every planned inflow and outflow for the coming quarter — capital contribution, loan drawdown or repayment, dividend, service fee, liquidation — with the lead time, filing and bank evidence each one needs, so nothing is requested the week it is due.
- 02
Capital-account and loan-registration control — Confirmation that each movement goes through the correct account, that foreign loans are registered and reported on time, and that the figures in the registration certificate, the bank and the books agree.
- 03
Profit repatriation readiness check — Before any dividend is declared: audited statements, corporate income tax finalisation, no outstanding tax debt and the required advance notification to the tax office — with the dates by which each must be in place.
- 04
Owner and expatriate exposure watch — For directors and investors personally: tax-debt exit-restriction risk, personal transfer evidence and residence-card alignment, reviewed each quarter so a company issue does not become a personal travel issue.
- 05
Bank and regulator liaison on retainer — Standing correspondence with your bank's compliance function and, where a filing is needed, with the regional branch of the central bank — handled under mandate within the retainer, with a quarterly written position statement.
- 06
Priority response for an unplanned hold — When a transfer is frozen or queried outside the calendar, the retainer gives you a named contact and a two-working-day start on the response file.
Delivery routes
Choose the level of support that fits your capacity, timing and desired control. Each party's role is confirmed before work begins.

you keep execution; LotusGuard provides the costed roadmap, working notes and review checkpoints.
Route B — We execute under mandate
LotusGuard prepares and files the agreed work within the written authority.
Route C — Independent third-party QC
where a licensed specialist is required, LotusGuard vets the provider, holds one timeline and supervises delivery for a disclosed management fee.
Timing and quote

Legal notice
LotusGuard prepares, organises and presents documentary evidence of the origin and purpose of funds, and liaises with banks and tax offices on your behalf under a written mandate. LotusGuard does not structure, split or disguise transactions, does not accept engagements where the origin of funds cannot be evidenced, and keeps client-identification records as if it were a reporting entity under Vietnam's anti-money-laundering law. Bank statements and tax records are sensitive personal data: they are collected only with your recorded consent, used only for the engagement, and deleted on the schedule stated in the engagement letter. The decision to execute, delay or refuse a transfer rests with the bank; no outcome is guaranteed. This is an independent advisory deliverable, not a legal opinion issued by a licensed law practice.
