Overstay Handling

What you receive

Same-day exposure assessment — We calculate the length of the overstay, the administrative penalty band it falls into, and the risk of an entry ban — in writing, before anything is filed. You will know the worst case on day one.

Voluntary declaration prepared correctly — Overstay is handled as an administrative violation. A file presented voluntarily, completely and with the correct explanation is treated differently from one discovered at a border counter, and we prepare it accordingly.

Penalty handling and record of violation — We attend the process, obtain the record of administrative violation and the receipt for the penalty, and keep the paperwork that proves the matter was closed properly.

Regularisation pathway, not just a fine — Once the violation is closed, we set out the lawful route back to a valid status — extension, conversion, or exit and re-entry — with the real cost and timeline of each.

Written handover and forward protection — The complete file of what happened and how it was resolved, plus the monitoring that stops it recurring. This is the single most common file we see, and it is almost always caused by nobody watching a date.

Route A — You act, we guide
You keep control of execution. LotusGuard provides the costed roadmap, working notes and review checkpoints.
Route B — We execute under mandate
LotusGuard coordinates and files the agreed work within the authority and scope set out in writing.
Route C — Independent third-party QC
When a specialist provider is required, LotusGuard vets the provider and supervises delivery for a disclosed management fee.
Timing and quote
Fees are fixed against the scope stated in the quote and applied consistently. The quote identifies included work, exclusions, assumptions and any pass-through costs.
Legal notice
LotusGuard provides procedural advisory and files your dossier under a power of attorney. The decision to grant, refuse or revoke rests solely with the competent Vietnamese authority; we do not sponsor applicants and we do not promise an outcome. Your original passport stays with you — we work from certified copies wherever the law allows. Government fees, official charges, translation and consular legalisation are payable by the client at cost, at the published rate.
